Facing Foreclosure in San Antonio? 7 Options Texas Homeowners Should Know Before Selling
Receiving a foreclosure notice can be frightening. Maybe you've fallen behind on your mortgage because of a job loss, unexpected expenses, or a major life change.
But here's something I want every San Antonio homeowner to understand:
A foreclosure notice doesn't automatically mean you've lost your home. And selling isn't always your only option.
Before making a decision, let's look at seven possible paths.
1. Loan Modification
Your mortgage servicer may agree to change certain loan terms to make your payments more manageable. Approval depends on your loan, finances, and eligibility.
2. Repayment Plan
If your hardship was temporary and your income has recovered, your servicer may offer a way to catch up on missed payments over time.
3. Forbearance
Some homeowners qualify for temporary payment reductions or pauses. Remember, forbearance doesn't erase the amount owed. Ask how missed payments will be repaid.
4. Reinstate Your Mortgage
Reinstatement means bringing your loan current by paying the required past-due amount and applicable charges. Request a written reinstatement quote and confirm the deadline.
5. Sell Your Home Before Foreclosure
If keeping your home isn't financially realistic, selling before foreclosure may allow you to protect some of the equity you've built.
Before accepting a cash offer, compare your property's market value, payoff, liens, selling expenses, and estimated proceeds.
6. Explore a Short Sale
If your home is worth less than the amount owed, your mortgage servicer may consider accepting less than the full payoff.
Short sales generally require lender approval and may have credit, tax, and deficiency-balance implications.
7. Get Independent Housing or Legal Assistance
A HUD-approved housing counselor can help you evaluate mortgage assistance options, often at no cost. An attorney can explain legal rights, foreclosure deadlines, and whether bankruptcy or another legal remedy is appropriate.
How Fast Can Foreclosure Happen in Texas?
Texas has strict foreclosure procedures. In a typical nonjudicial residential foreclosure, state law requires at least 20 days to cure the default before the notice of sale and at least 21 days' notice before the auction.
Different requirements may apply to certain loans and types of foreclosure.
Don't assume you have until the auction date to take action. Contact your mortgage servicer and obtain qualified guidance as early as possible.
My Advice to San Antonio Homeowners
I believe every homeowner deserves to understand their options before making a major decision.
Sometimes keeping your home is the right solution. Sometimes selling and protecting your equity is the better path.
My job isn't to pressure you into selling. It's to help you understand the real estate side so you can make an informed decision.
